These legal terms constitute a legally binding agreement between you and Wig Wag Simulations in regards to usage of our services. You agree that by accessing these services, you have read, understood, and agreed to be bound by all of these legal terms. Failure to comply may and will result in disciplinary action. If said user is a minor (under the age of 18), you must have a parent or guardian read, understand and agree to these legal terms before using our services.

Our Services… We provide downloadable custom content for N3Vs “Trainz Railroad Simulator” line (Excludes the mobile versions). This includes models such as locomotives, rolling stock, and scenery assets, and also includes routes, custom sounds, reskins and kitbashes of other content provided by various authors (Jointed Rail, RRmods, CPS, and various authors of the DLS) and misc assets such as png files for additional detail for reskins. We do not accept commissions.

User Guidelines.. Upon purchase or download of any of our products, you hereby have read, understood, and agreed to the WWS EULA (End User Licensing Agreement. EULA may differ per product), which is provided upon each purchase. Failure to comply with the EULA may result in disciplinary action. Conversion of our assets to mobile variants such as Trainz 3 or Trainz Driver 2, or other railroad simulators not affiliated with N3V is strictly prohibited. Refer to the Termination Clause. Products are provided AS IS. We are not responsible for any potential damage to your software or device as a result from downloading any of our assets. Support is no longer guaranteed if the assets are modified after download.

Product Availability… All products are guaranteed 24/7 availability unless stated otherwise. We reserve the right to discontinue any asset at any time without notice to you. Prices are subject to change without notice to you.

Intellectual Property… Most of what can be found on the website are legal intellectual property of Wig Wag Simulations. This includes, but is not limited to, the Wig Wag Simulations name, logo, website design, photos, sounds, videos, and provided models and or routes holding the official WWS EULA. Re-use of the Wig Wag Simulations name, logo and site design for personal gain is strictly prohibited. Refer to the Termination Clause.

Payment and Refund Policies… Payment MUST be provided digitally through our checkout page via PayPal, Venmo, or Debit Card. Incremental payments will not be accepted. All sales are final, refunds will not be issued under any circumstance.

Limitations of Liability… We are within no bounds or responsibility for any direct, indirect, consequential, exemplary, incidental, special or punitive damages, which include loss of revenue, profit, data, or other damages from usage of our services. Content Permission for Outside Use Re-use and redistribution of any assets provided from our site, which include locomotives, rolling stock, scenery assets, routes, sounds, and other assets is strictly prohibited without proper written permission from the WWS team. If you wish to use any of our assets for an outside source, such as another website, game or other personal projects intended for public release, please refer to our EULA Section 2.

Termination Clause… We reserve the right to terminate your account if you are accused of violating any of our terms, which can include, but not limited to, redistribution of our assets to outside sources without written permission, redistributing purchased content, reuse of our intellectual property (which may and will result in disciplinary action in the court of law), or any failure to comply with the written EULA. Account termination decisions are final and will not be reversed under any circumstance. If you wish to continue using our services, you will need to create a new account and agree to the Terms and Conditions. Your purchases from your previously terminated account will NOT be transferred to your new account.

Miscellaneous… Our terms and conditions may be updated from time to time, and users will be notified each time via message announcement on our website. Be sure to read the changes before continuing to use our services. These legal terms operate to the fullest extent permissible by law. We may assign any or all of our rights and obligations to others at any time. We will not be responsible or liable for any loss, damage, delay, or failure to act caused by any cause beyond our reasonable control. If any provision or part of a provision of these legal terms is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these legal terms and does not affect the validity and enforceability of any remaining provisions.
